Afin de faire état de la terminologie du droit privé québécois, le Centre Paul-André Crépeau de droit privé et comparé a lancé en 1981 le projet des Dictionnaires de droit privé et lexiques bilingues.

En exprimant le droit privé dans les langues anglaise et française, les Dictionnaires de droit privé / Private Law Dictionaries sont des outils de connaissance originaux qui tiennent compte du fait que le droit privé québécois évolue dans un cadre linguistique et juridique unique au monde. Ils constituent les seuls ouvrages de terminologie juridique pouvant prétendre refléter la spécificité bilingue et bijuridique de la culture juridique québécoise, en plus d’être un outil essentiel pour l’ensemble des juristes québécois, pour les traducteurs juridiques, pour les juristes de l’ensemble du Canada intéressés par le droit civil québécois et, enfin, pour les juristes œuvrant en droit comparé.

In 1981, the Paul-André Crépeau Centre of Private and Comparative Law launched its Private Law Dictionaries and Bilingual Lexicons in order to present the terminology of the Quebec private law.

By expressing the private law in the French and English languages, the Private Law Dictionaries/Dictionnaires de droit privé are original tools which take account of the unique linguistic and juridical landscape in which the Quebec private law evolves. These are the only publications of legal terminology which can claim to reflect the bilingual and bijuridical specificity of Quebec’s legal culture. They serve as an essential tool for jurists and translators in Québec, for those across Canada interested in the Québec civil law, as well as for those working in the field of comparative law.

This website gives access, in their French and English versions, to the following dictionaries : the Private Law Dictionary, 2nd ed. (1991), the Private Law Dicitonary–Obligations (2003), the Dictionary of Private Law–Property (2012), the Private Law Dictionary–Family, 2nd ed. (2016). The Private Law Dictionary-Successions is in progress, and will gradually be added to the database.

CONTRACT OF CARRIAGE
(Obl.Contract by which a person, the carrier, undertakes, for remuneration, to take a person or to convey property from one place to anotherIn addition to serving as evidence of a contract of carriage, the bill of lading is also a receipt issued by the carrier, the terms of which describe the condition of the goods received” (Tetley, (1977) 23 McGill L.J. 668, p. 668) Occ. Art. 2030 C.C.Q.Obs. 1º The parties to a contract for the carriage of persons are, in general, the carrier and the passenger. The parties to a contract for the carriage of goods are the carrier, the shipper and the consignee; the shipper and the consignee may be the same person2º In the Civil Code of Québec, the provisions respecting the contract of carriage apply only to contracts of carriage by onerous title (compare art. 606, Bk V, Draft Civil Code, C.C.R.O.)3º Contracts of transport by onerous title give rise to an obligation of result (arts. 2037 and 2049 C.C.Q.). By contrast, the gratuitous carrier is, in principle, only bound by an obligation of means (art. 2032 C.C.Q.)4º The carrier may not exclude or limit his or her liability for bodily or moral injury caused to another, nor for material injury caused to another through an intentional fault or gross negligence (arts. 1474, 1475, 2034 C.C.Q.)5º The codal regime respecting the contract of carriage governs carriages by onerous title to be performed inside Quebec (s. 92(10), Constitution Act, 1867). According to some scholars, the provisions of the Civil Code may also apply as suppletive law to interprovincial carriages, although, in principle, these fall under the exclusive jurisdiction of the federal Parliament (ss. 92(10)(a), 91(29), Constitution Act, 1867)6º In light of the decisions of the Supreme Court of Canada in Triglav v. Terrasses Jewellers Inc., [1983] 1 S.C.R. 283 and ITO-International Operators Ltd. v. Miida Electronics Inc., [1986] 1 S.C.R. 752, marine insurance is a matter of Canadian maritime law. The exclusive federal jurisdiction over this matter originates in article 91(10) of the Constitutional Act, 1867 (navigation and ships (shipping)) and of its jurisdiction over admiralty as defined at section 2 of the Federal Court Act (R.S.C 1985, c. F-7).
